this guy(I have no clue who he is,but he sent me this email the other day can you believe this BS?:huh would
you have any advise?(he ask me)
about 4 weeks ago I was charged with recless driving.
An attorney Louis Hart from Homedale signed a citation , because I was
"fishtailing" my atv on BLM land between Marsing and Homedale.
I ride a 2000 Suzuki 500 Quadmaster ( a real speed demon, huh?)
If this goes through, anytime anyone spins a tire , pops a little
wheelie,or gets a little sideways will be charged with reckless driving,
up to 300 dollar fine,30 day manditory loss of drivers licence and 5-90
days in jail.
I go to court Jan 12 any help would be apreciated

Is this a common thing in your State? I had no clue what to tell the poor guy......:confused:

Wow! Thats almost scary cause i ride alot of BLM, I would tell him to call his BLM office and find out the exact rules..... I've never heard of such a thing! and im sure that there is some way he can fight it....He should just do some research and find out what exactly there accusing him of....Sounds like a bunch of BS to me though!

Appparently he used to be Sherriff around here or something:confused: so he should have an idea who to go and talk to I would think?????? Im just amazed by this......:mad:

yea thats pretty wild in our county mike crazy 400 ex man got it so if a wheel of a quad touches the road u get like a 500 dollar ticket and community service so he messed us up riding on the road with his cobra

I havent heard much other than a sheriff post some stuff on a thread here locally about his leagal rights a little. I will keep up to date on anything I find out. I think this guy just got the shaft:(

Sounds like we may not be hearing everything// but if we are he should contact the ATVA (part of the AMA) and talk to their legal department, they enjoy stuff like this !! I am not as familiar with BLM land but in any other national forest it would not be any problem, I work on 2 trail systems that are on federal property and we have meetings with the forest rangers every quarter and they have never mentioned anything like this, if you ride off the trail systems and on the roads its the only time you have a chance at getting a ticket //let us know what happens

heres the letter I got about this......
Hi Tina,
Sorry did not get back to you sooner, went to court for my prelim. monday
the 23rd, and it was dropped. The reason it was dropped was because I
called the Sheriff for some dirt bikes and atv's doing the same offense
and they failed to charge them, it's whats known as "selective
enforcement" (my lawyer is gearing up for battle with the Sheriff dept).
anyway I don't think the off-road community has any worries, it was just
an attacked aimed at me. Now it is my turn to counter agianst them.

ya im glad it was dropped
my mom works for BLM and i asked her if shed ever hurd of anything like that and she said not here, so im thinking the cop was just board and wanted somthing to do !!!

Sounds like someone needed to meet thier quota for the month what a bunch of chit!!!! I think I would have to tell them they are friggin crazy if they tried to ticket me for something so anal!!!!

they dont give me flak in my artea but u gotta think at some time, now do they see why alot of people on quads will run from the cops?!
im not saying thats what u should do at all, but if that was going on in my area and i want doing anything wrong and they was throwing tickets at everybody, they had better want to catch me real bad is all i can say
