Topic: Wisconsin state law “Under age 12 - Youth ATV racing” issue – potential legislative language changes


Inviting all club race promoters, race track owners, and interested / affected parties:


Input and discussions are needed from affected parties that we may wordsmith the requested changes to our representatives in Madison. We have spoken to State Representative Mark Pettis who has agreed to work with us on the process for submitting a change in Wisconsin state law that currently prohibits any child under age 12 to race or participate in any kind of competitive derby.

Now we need all the main players together so we can get everyone on the same page, clearly assess where we stand and as importantly, hear from the group what an updated and changed law would look like with from your perspective.

A meeting date has been set for Saturday, March 1st in Oshkosh, Wisconsin. Sign-up at 11:30 AM with the start time to follow. We need to be out of the room by 3:00 PM.

The banquet hall is connected to the new Hawthorne Suites just off of Hwy 41 (see directions below). We will be in a room that seats about 75 people. Look for signs that indicate WATVA Youth ATV Racing or some lettering to that affect.

Please spread the word that we need those clubs and promoters that want to give input on the following topics:

1) Wording changes that apply to “under age 12” (current law reads – Children under the age of 12 cannot compete in races. There is no provision that allows a child of this age to ride any ATV except for the allowance listed on page 8 of Wisconsin law book). That portion applies to no child under 12 can ride on the frozen waters of the state.

2) Definition of “sanctioned race”

3) Definition of a “raceway facility” (this might get tricky specifically for those facilities on frozen waters)

4) WATVA would like to refine or in some cases define the different “types of race or derby categories” ie; off-road challenge, mud run, MX race, hare scrambles, etc. For the MX races and more traditional categories this isn’t a big deal but for categories like dirt drags, mud runs, off-road challenges, pulls, etc., it would be of benefit for the various clubs / promoters that may be wanting to explore holding these types of events themselves to really know what their generic definitions are.

5) Suggested classes for the above event / race categories for the reason of providing more standards that the ATV consumer has an idea before arriving at the events what the usual and customary classifications are?

6) We need to talk about the “sound level issue”. Current state law reads – “During races, ATV are NOT exempt from the requirements to be equipped with a functioning muffler and spark arrestor.” It seems races on private property versus races on public property will have some effect on the logic regarding sound levels?

7) Mandatory accident reporting for races versus other kinds of ATV accidents

Please try and send at least one or two representatives to this important meeting or send your thoughts ahead of time that we can distribute to the others in attendance.

Located in Oshkosh on the west frontage road just south of the outlet mall. Our beautiful 11,000 square foot facility is attached to the new Hawthorn Inn & Suites Motel. Our banquet hall has seating capacity of about 300 guests for round tables and almost 400 guests for buffet tables. The main ballroom splits into 4 smaller rooms, plus we also have 2 boardrooms available.

The Banquet Hall is easy to get to. Were on the west frontage road on Hwy 41, right next to the outlet mall in Oshkosh. Centrally located in Wisconsin just 60 miles South of Green Bay, 70 miles north of Milwaukee & 80 miles north east of Madison.
