Piston rings incorrectly gapped?

I was gapping my piston rings from the bottom of my cylinder bore, the JE piston spec sheet said it had to have a minimum of .018" .... I got them to the minimum spec then I thought "oh, I should check them at the top of the bore" ...... they were at .022" at the top..... and at .022" in the middle..... Is this fine?

Yes it will be fine but it sounds like your cylinder is out of round. I am assuming it was not bored? I have seen, and put back together engines with more gap than this. You may get a little oil consumption but should not be a problem if checked.
