gas in the oil!?!?!?

i bought a ltz400 about a mounth ago and teh first few times i rode it it burned oil like a 2 stroke and now i checked it and i think there is gas in itit over flows everytime i check it

what is causing the problem and what can i do to fix it

first guess is that the needle is not seating and its letting gas go through and in to the oil.
as for the smoke, could be ring ware or oil is being forsed into the carb up through the hose in the intake boot
