07 dvx help....

iam looking at this dvx the kids says it will not stay in 4 th gear keeps jumping out.. iam thinking a bent shift folk?? he says no he thinks it the shifting paw. i think hes wrong what u all think?? wtf?this bike only has 50 hrs he says but i think he beat the **** out of it?help
