Ok heres my problem, I bought a cell phone off ebay on the 28th of last month. I paid for the phone within an hour of the auction ending. I bought the phone off ebay because I lost my other phone and needed a new phone asap. Well its been 15 days since the auction ended and the lady hasn't sent me a shipping conformation/ tracking number or answered any of my 4 emails. My cingular contract is up the october first and then I will be switching to nextel and I won't be able to use the phone anyways. How long should I wait before I leave her negative feedback and notify paypal to withdraw funds from her account ?

if she has not been in contact with you for two weeks i would say that is long enough. call paypal today and get your money back

same thing happened to me, not over a cell phone but over a grab bar. I filed a claim against them and got instant responses then. Also what was her rating? I will not deal with people that have a rating under 99%

Her rating is 50 with no negative feedbacks at all.

How long should I wait until I escalate it to a claim.

if they are legit at all they usually respond quick when paypal gets into the hunt

dido on the 99% or higher
(even then I usually check for withdrawn feedbacks)

file the claim, it can always be canceled if you get the goods

not a second longer. If someone is evading responding to your e-mails, YOU need to take action.

I filed the dispute yesterday, the lady reponded this morning with an email saying she sent the phone that I bought from her the Tuesday after labor day.

10 minutes after I recieve the email from her I get 2 emails from service@paypal.com saying my package will be shipped today. Each email from paypal has a different tracking number. I run the tracking numbers at USPS.com and there is no rcord of either of them. I escalated my dispute to a claim about an hour ago. I then looked up her phone number and gave her a call (I know its kinda creepy but I want my money back) She picked up the phone and hung up as soon as I told her who I was. She is 37 years old, married, owns her home, and has 2 kids. Why she is ripping me off for $68 is beyond me.

if you have her phone number you can look up her address by reverse phone book................

if you have her phone number/address and all the info on her kids and stuff it may scare her into holding up her end of the bargan.

funny how soon they reply when you open a claim
its not worth your 68 bucks to lose her account
I do think it may be time to leave the neg. feedback
