A new Bill is on the dock and it concerns ATV's. I'll include the actual bill a little later. In a nutshell, if you're under 16, you won't be able to ride anything bigger than a 90cc. Also... no riders under 12. Not even on a 55cc with a teather. Also...no passengers. So parents can't even CHOOSE to take their tykes across a FLAT dune.

I can already hear the reasons why..."ATV's are dangerous." But the legislators are either grossly misled, or trying to shap society in the wrong direction.

SUMMARY The following summary is not prepared by the sponsors of the measure and is not a part of the body thereof subject to consideration by the Legislative Assembly. It is an editor's brief statement of the essential features of the measure as introduced. Prohibits operation of all-terrain vehicles by persons under 12 years of age. Restricts operation of all-terrain vehicles by persons 12 to 15 years of age based on vehicle engine displacement. Prohibits sellers of all-terrain vehicles from knowingly selling all-terrain vehicles for use by persons under 12 years of age or for use by persons 12 to 15 years of age in violation of engine displacement limitations. Punishes by fine of $90. Directs State Parks and Recreation Department to produce and provide safety information to retailers. Directs retailers of all-terrain vehicles to distribute safety information to buyers of all-terrain vehicles. A BILL FOR AN ACT Relating to all-terrain vehicles; creating new provisions; amending ORS 821.203; and repealing ORS 821.292. Be It Enacted by the People of the State of Oregon: SECTION 1. { + Section 2 of this 2007 Act is added to and made a part of the Oregon Vehicle Code. + } SECTION 2. { + (1) A person who is in the business of selling all-terrain vehicles commits the offense of knowingly selling or offering to sell an all-terrain vehicle for use by an unauthorized operator when a person sells an all-terrain vehicle: (a) For use by persons under 12 years of age; or (b) With an engine displacement greater than 90 cubic centimeters for use by persons under 16 years of age. (2) The offense of knowingly selling or offering to sell an all-terrain vehicle for use by an unauthorized operator is a Class D traffic violation. + } SECTION 3. { + A person who is in the business of selling all-terrain vehicles shall distribute informational materials regarding state laws, safety requirements and training programs to purchasers of all-terrain vehicles at the time of sale. The State Parks and Recreation Department shall develop and provide the informational materials for distribution to the sellers of all-terrain vehicles. + } SECTION 4. ORS 821.203 is amended to read: 821.203. (1) A person commits the offense of endangering { - a Class I or Class III - } { + an + } all-terrain vehicle operator or passenger if: (a) The person is operating a Class I or Class III all-terrain vehicle on premises open to the public and the person carries another person on the Class I or Class III all-terrain vehicle who is under 18 years of age and is not wearing a motorcycle helmet; { - or - } (b) The person is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child under 18 years of age and the child operates or rides on a Class I or Class III all-terrain vehicle on premises open to the public without wearing a motorcycle helmet { - . - } { + ; (c) The person is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child who is at least 12 years of age and not more than 15 years of age and who operates an all-terrain vehicle with an engine displacement greater than 90 cubic centimeters; or (d) The person is the parent, legal guardian or person with legal responsibility for the safety and welfare of a child under 12 years of age and the child operates an all-terrain vehicle. + } (2) The requirement to wear a motorcycle helmet does not apply if the all-terrain vehicle is: (a) Used exclusively in farming, agricultural or forestry operations or used by persons licensed under ORS chapter 571 exclusively for nursery or Christmas tree growing operations. (b) Being used on land owned or leased by the owner of the vehicle. (3) The offense described in this section, endangering { - a Class I or Class III - } { + an + } all-terrain vehicle operator or passenger, is a Class D traffic violation. Sir,
I am writing in regards to Bill 49. It’s the one that further restricts ATV freedom. I am opposed to this bill and urge you to abandon its’ pursuit. The concept behind the motivation seems easy enough to understand, “ATV’s are unsafe.” Such a narrow minded approach is unrealistic. Yes… ATV’ing is an inherently dangerous sport, like snow skiing, hang gliding, kayaking, football, and many others. People have the right to pursue dangerous sports…within reason. I can understand “no-drunk driving.” I can understand keeping a pre-teen off an adult quad. But off a 90cc? A 90cc can’t even MOVE in the sand with a 10yr old on it. If you believe otherwise, it’s because you’ve been misled; probably by people who were paid to mislead you. I have spent many years in the dunes. I enjoy seeing families share the sport. I enjoy seeing the teenagers spend time with mom and dad. I really enjoy seeing the middle schooler DROP their computer game to go out and ride with mom and dad. But this bill won’t even let parents CHOOSE to take their OWN children for a ride WITH THEM. I did not vote for this and I will not obey it. If it passes YOU will have to be the one who answers to the children. This Bill is too restrictive.

Dear Tim,

Thank you for sharing your concerns regarding Senate Bill 49. SB 49 was precession filed and is in the Senate Committee on Business, Transportation, and Workforce Development. Senate Bill 49 is one of five bills introduced relating to ATV’s. The Oregon State Parks Department, at the request of the Governor is sponsoring the other four bills.

Senate Bill 49 is trying to protect children from unnecessary injury or death. Between 1999 and 2005, 62 Oregonians died from riding all terrain vehicles, children under 16 accounted for 17 of those deaths. Nationally, in 2004 there were 130 reported ATV related deaths of children under the age of 16. The top cause of ATV related deaths to children under age 16 was crush injuries from rollovers. These rollovers are commonly caused by children riding adult size ATVs. Senate Bill 49 takes children off adult size ATVs and thus reducing injury and death.

The Safety Institute recommends that children 12 and older should have an ATV between 70cc and 90cc and only children over 16 should ride ATVs over 90cc. Senate Bill 49 is following the ATV Safety Institutes ATV size recommendations. Please note that the ATV Safety Institute is industry supported.

I encourage you to follow SB 49 and continue to partake in the legislative process.

I did some homework.
Between the years of 1991 and 2001 there were 1033 deaths of children under the age of 5 caused by drowning in their own home bath tub. That's for the state of California alone. (Source: http://www.dds.cahwnet.gov/drowning/) If we assume that a remotely similar number of deaths happened in all 50 states, that's quite a few deaths. So why aren't there bills restricting bath tub use?
ATV's are an easy target.

This bill is too restrictive. The bill is nothing short of presenting a false image of effective action in protecting children. Parents should have the right to choose to let their own children ride certain machines. They should also have the right to put their child on their own machine and take them for a ride. This bill restricts a parents right to choose. America is about liberty and that's what I'm supporting. I will not obey this bill if passed. It sends the wrong message and sends our country down the wrong path.

A agree that bill is too restrictive, and I'll write a letter, since I do ride in the Oregon Dunes occasionally (used to live there too).

This is one of those tough issues. 80% of the 13 year olds I know have no business being on anything larger than a 90cc.. yet theres that 5-10% that could outride me.

I wish they would be more dynamic on these bills. Have an age restriction, but also have a way to bypass the restriction if you qualify. Tested and Licensed.. etc up to a 350cc.

I know very very very very few 14-15 year olds that should be on a 450 or a monster UTE. Heck, most adults shouldn't be on a 450.. lol.

Perhaps they could just institue an Adult Supervision required rule. So if a 13yr old kid is found roaming the dunes on a Cheeta Banshee w/o adult supervision, the parents would get fined.

Sounds like a reasonable and safer comprimise to me. Wont affect the responsible parents too much (some inconvieniences, like sending them up to the camp store for ice, lol) But may help keep the irresponsible parents in check.
