Time for Brakes?

I got my 2003 250ex back in feb of 2004 and now my rear brakes are sticking, I'm not sure if it is just the cold or what since they never stuck when it was cold last year or the year before and also they are getting "loose". I pull in my brake lever and the brakes don't respond like they used too. But also what could cause the brakes to not un-engage when I let go of the lever. They un-engage only when the quad stops. Then that brake lever on my case pops right back into place. I would call the honda shop but all they would say is bring it in.

can u disconnect the cable at the rear end and then pull the brake perch.see if the cable is frozen.

Well I disconnected the cable on the case and pushed that brake perch back and forth freely if thats what you call it because that's the only thing that the cable is connected to.
