well ... we ran into a big problem. my buddy was getting this track built on his moms land and now that she saw how the track was coming she got worried and called her attorney and he said that basically its a terrible idea to have the track and that a waver wont hold up in court if somebody got hurt. shes worried about the neighbor kids getting hurt on the track so basically we cant have the track anymore. has ANYONE actually encountered this type of problems themselves?? what did you do to solve it?? i always thought a waver was like signing your soul away but i guess it doesn't mean much according to her attorney............

we weren't the ones building it, outofcontrol and his buddy were running the equipment. yeah sure we could ride on it but theres too many people who ride around there, such as little neighbor kids and such

anyone have any ideas, that make it safe for a land owner to have a "private track". Its gonna kill me to plow over the jumps because of an attorneys opinion.

no tresspassing signs posted ever 5 feet apart all around it.

does that make it safe to avoid a potential lawsuit? that way they couldnt say they didnt see a sign right?

No matter hwat you post (signs etc) it will not prevent a lawsuit even from someone trespassing. You could even fence the dang place 10 feet high and they could sue you because they cut themselves scaling the fence.


Waivers, posted property, fences with locked gates are all needed but still will not offer you any solice with regards to potential lawsuits.

Sure does suck, but thats where we have gone as a society.

Ya, unfortunately you can get sued if anything was to happen... But i'd still go along according to plans taking all precautions and only allowing good friends to be able to step foot on the track! I'd also tell any others that if they ever think about it, you will press charges for trespassing (Say it in a mean voice to try and make them scared;) ) But I wouldn't give up on it just cause some neighborhood punks.

well it just doesnt look good for us ... i just dont understand how she (my buddies mom) can let people ride through the property the way it is now and be okay with it but she wont let anyone hit a couple jumps on the track.

i heard that tri-county atv got around this problem by making it a club and members have to pay dues to ride there...anybody know about this???
