Heeelp!!

i have a brand new 06 yfz which i have practiced on a few times, never been flipped, abused or anything. and when i pull in the clutch in the bike starts and it engages the starter every time you shift which kills the battery. anyways its very annoying and im pissed beacuse i took it to yamaha to get it fixed and they have no clue how to fix it. there words where "it cant be fixed" so my dads like wtf ok give us a new bike then and they gave us an 1-800 number to call and its just bs, its there problem how can you not fix something. what i am asking is i just want to solve the problem and i want a kick start! i have already asked before with one reply where can i get one without cutting the rear fender like the one ellis runs? can yall please help me and tell me a site i can go and look at one.
