TCRacing416ex has been screwing over ATV riders members

TCRacing416ex has screwed over three members that I know of. Does anyone know this kid? His name is Adam Miller and he lives at 1336 Kent Road; Ortonville, Michigan, and his phone number is 248-627-5067. So far he has one member for $290, another one for $250, and me for $100.

If anyone knows him or had any dealings with him, please let me know and if he is a friend of yours, bake him a cake with a file in it because he is going to jail!!

400ex quader if you call the cops today give them my name and #. He is wrong if he thinks paypal had dropped the claim because it is 45 days not 30 and I filed my claim in 29 days I told him it was 30 days to hurry him up, so this shows how smart he is. He is piss at me and is calling my house all hours of the day and hanging up just because I keep leaving messages on his machine. He does live at the 248-265-5065 his dad told me he does. It sounds like he is trying to get away with something by getting you to sign when (and if) you do get a box it may not have what you want in it and that is mail fraud.
We need to make sure markeg192 gets in on this he got ripped off by this jackoff for $290

If you indicated on the money order what the MoneyOrder was for, him cashing the check is a bindind agreement that can be used in court. In fact, I would raise a civil suit against him in addition to calling the cops.

Informing the IRS in a professional letter that you beleive, due to his business practices, that he's not claiming this income on his taxes. Don't mess with the IRS. ;)

also for those of you who used paypal and paid with a credit card, just call your credit card company and cancel it. your credit card company will go to bat for you. paypal will not. they(owned by ebay) just want to collect their fees and not much else. i had this happen with an ebay item, and since it was past(then) the magical 30 day mark paypal said they won't/can't do anything. but when i called my credit card company and cancelled it, it actually cancelled the payment to paypal....you should have seen paypal move then...even after the magical 30 day mark.

also i would believe if it was paid with your checking acct. i would think that your bank could/would do something about it....once again goodluck guys and let me know...;)

I have been in touch with Oakland Co. Sheriff and they are having QueenAnnes Co. do an investigation and they will be here friday to fill out a full report on this end and then it will be handled in Oakland co. I need all the info sent to me to put in the report, then anyone else will be able to file in their own county but under the same investigator in Oakland co.
He did try to call me yesterday but I didn't get an answer when I called back.

What gets me is that when you are selling something either on the internet, in the local paper, or in person, when the person pays for what they are buying you should get it to them/shipped out to them ASAP-not weeks and weeks later. When the item is shipped you should have a priority number from USPS or a tracking number from UPS or Fedex. He has destroyed his reputation and will end up having a police record. How old is this kid? He looks like he is no more older than our son. He is dealing with older adults on this end and kids like him give other kids like 400EX Quader a bad name because of being young. 400Ex Quader-you are not a bad person-just know how old you are and using you as an example.

The sheriff is coming on Friday to our house for a full report not only on the internet/mail fraud but also the harassment of calling our number all hours of the night.

For the young adults that were obviously raised in a correct manner, please learn a lesson from this kid's mistakes. If he gets a felony record-he won't be able to get a job for any State, Federal, or the Military. Not saying that he would want to but you never no where life will take you.

All I want is the money sent back. To hell with the head at this point. I will go out and buy a brand new one if I have to before having to go through this ordeal again!

It just keeps getting better, I missed the UPS man today so I stopped by UPS to pick up the box but when they brought it to me I saw on the lable it only weighed 4 pounds so I told them I didn't want it now and to have it delivered to my house on friday. Why you might ask, their is no way their is a 400ex head in that box so I have the sheriff's office going to stop by so they will be here when I open it for the report. I left a message on his cell and he called back real quick and just started a lot of cussing and saying I have to sign and all that I just calmly said "mail fraud" then he said "you don't want to take me on in court and I have a lot of money and I have more stuff then you ......." I then said if you have all that why don't you pay us back then? Then he just kept cussing then hung up.

ok here is what was in the box 1 fram oil filter, one car transmission mount and a little piece of wire. by friday the oakland co. sheriff have gotten the report from my local sheriff I will have a case # in a few day and be able to post it up here so anyone else who has a problem can contact them with the case # . He called me friday asking what my problem was and I told him it is out of my hands now, thenI said have a nice day and hung up. He called back and said he contacted the police and filed a harrassment complaint. then I told him pay pal hadn't closed the case and they were curious why the pkg that only weighed 4lb. when it should have been 8. he then said you won't any $ back I changed my paypal account to one with more $ , I then said if you have so much $ why don't you pay the people you owe. and then said "have a nice day" click...

Hey Guys, His DAd owns Thunder Hills Ranch. There is a website with contact info. I have emailed his dad twice and no answer yet. It looks like there are enough of us scammed to prolly get him charged if everyone persues it. My guess would be he lives in an area where there's not much in the way of law enforcement. Still I believe Mail Fraud is a Federal offense.

He is in deep and he is scared as he should be. As for the mail fraud since I didn't pay with a money order, mine would be considered internet fraud. I am still going to persue this because it will be like a vacation to me to go out to court and then take the rest of the week to go to Silver Lake or the Bad Lands! You need to have a police officer open the package for you, right off the UPS truck. If you call UPS the morning the package is to be delivered, change the delivery adress to your police station. The be there for the cops to open it. Bam, there's your proof.

400exquader, I was talking to a friend who does alot of ebay/internet sales about this. He says you should call your post office and tell them what's going on. They will let you file a complaint there since it was a USPS money order. He has done it and it went well for him. He is Johnnyand monica on here so you should PM about it.

You could probably even have the UPS man verify what is in the package and he can add that to his machine after you sign. This will back you up too. Then take the box to the police. As long as you have proof of what was agreed that you were buying and that is not what is in the box. Bam-see ya in court.

I really don't have a problem on going to Michigan. Go there every year anyway and he is only 20 minutes out of our way. So if we have to go out again, we will make another trip. Not a big deal. I would like to see what he has since he is only 23 years old and we are getting ready to hit 40 and he says he has sooooo much money. He might have some and it's ours that he stole! I think that he has gotten away with this for so long and no one has called him out and did anything. Well it's a different ballgame this year! We are playing hardball and he is not even in the same field as we are. :mad:

Here is my suggestion. Since i know the ****stick who is ripping all of you guys off.

First of all, hes only 20, not 23, and he has NOTHING. He simply thinks hes rich because his dad sued the county when his mother (adams grandma) was killed.

Send his MOTHER a certified/registered letter. Make sure she has to sign for it. This will make sure that adam cannot get his hands on the letter without his mother seeing it. Also get a return receipt on the letter. This will be mailed back to you, with her signature, proving that she got the letter.

In the letter, explain your transaction, and how he ripped you off. Include any pics, emails, AIM logs, etc for her to read. Stress to her that you have contacted the Oakland County sheriff and you are taking action.

I can guarantee that his mother has no idea about any of this. Talking to his pot head dad will get you nowhere. He will simply cover for adam while keeping his mom out of the loop.

If all of you guys do this, it will help. His mother knows hes ****ed in the head, and refuses to get him medical help because shes too embarrassed, and the father wont let it happen.

She picks up her mail at the post office everyday, shes guaranteed to get this letter.

This is the best way to do something. I do it in a different way though (sinplified),I go down to the flower shop and send a single flower to an address and if it is reayl they are required to sign for it and if it is fake then i get the flower back. I do ask for a return reciept and it shows there name Printed then their signature. I have taken a guy down in atlanta when i was selling my snowmobile. He tried to give me a fake MO and just have me send the sled to him. Not good to do when i have a buddy that is an investigator. He has a felony on his record now

Being that the sheriffs dept knows about it and hasn't done anything then really there is nothing that i can do 400ex quader. I can research my law books and see if i can find a loop hole somewhere. For the sheriff not doing anything though is pretty pathetic. :devil:. That and being in college for Criminal Justice is very nice when it comes to these situations.

You need to study more or pay better attention in class. The police have no real obligation to do anything for anyone by law. In addition this is a civil matter, not a police matter. I sat through 5 years of Criminal Justice and two degrees and when I got out the world slapped me right in the face. Those books don't even begin to prepare you for the real world. I wish you luck in the field of CJ, it's only gonna get harder in the future.

Well as sad as it sounds I have an instructor that I talked to about this matter because he worked cases this simple for the FBI not saying they were doing it because that is all they had they were doing to get scam artists.He said you need to start with the SHERIFF not the PD and get a record of what is going on. Sorry to tell you but i have a 4.0 and it is #2 in the nation for law enforcment training. I guess what do i know i only have some of the best training that is out there. Sorry for my possible input i will walk away and leave this alone. More schooling isn't always better. Sorry and for the farm equipment thing all they needed to do is have the sheriff file a service of seizure. If it doens't work then they arrest the guy for obstruction. Simple thing can be so rewarding. I am in a class where they did use a similar example and if a person is hiding the equipment they have committed another crime. Also for the time period, there is a 90 lean on all things seized then they go up on a sheriffs auction and then they can fight it and extend the lean if they are smart and they have money to take it to court. Anyways i am done and if you would like me to go even more in depth i would be more than glad to do it. better go get some coffee so i don't fall asleep!!

Look, I'm not trying to argue only get the proper information out there. My experience is not from behind a desk or from what an instructor told me. It's straight from the real world. Yes, you may need the proper paperwork from the Sheriff's department but in the end it is a civil matter.

As for the example I posted, two states were after the guy and it still took a long time to lawfully arrest him. Like I said, the real world is a whole lot different than what some college professor tells you. It sounds so simple to hear you tell it. One day you will understand. I eventually did.

Oh yeah, I'm a state police officer and my mom's a judge and deals with this all the time. I shoulda mentioned this earlier!

This isn't about who has the biggest degree, it's about how to deal with the scumbag. If you read what we said then you could easily see we're at least trying to get the right information out there for those that were done wrong.

There are so many ways a case like this can go that I could write a book and still not cover all the bases. Under the right circumstances he could be nailed with fraud which could get him jail time but that won't get your money back. Proving his intent is the main issue here. His past dealings are also a factor. Start with the Sheriff's Dept. in his county. In the end he can be put in jail under the right circumstances but that won't get you your money back. He can be ordered to pay and refuse and go to jail. A civil suit is then in order to get your money back by getting a lean on his property. In this case he lives at home and probably has nothing so he'll end up with this on his record for a number of years and loose his credit. If he ever acquires any property or gets a job then he can be forced to pay or he can be a bum for 7 to 10 years until his record is cleared and then you get nothing.

This can be a long hard road to recovering your money. At the least try to get him locked up but I'm not sure if it'll be easy to prove he even did this.

you can contact the states attorney and they will inform you of your options if criminal charges can be pursued. you can contact a lawyer in his home town and start a civil case against him,

He emailed and asked if he could order a shock and a couple other things. Joey and I discussed it and decided since he paid so promptly on the bottle that we would sell him the items. He paid again right away through Paypal and I got everything ordered.. He has pm-ed us a couple of times wanting tracking numbers.. he said he needed it by Easter for a race. I just looked through that IC3 form, you guys (who have been scammed) should all definately do that. The form is simple, and if they recieve a 4 or 5 of them tonight about him they might get very serious about helping you out. Just a form...and its very easy....

It's going to be impossible for anyone to get any of their money back.

You could file a complaint, mail fraud, internet fraud, whatever. If the guy doesn't have any prior convictions, he might do thirty days in the clink, but probably not.

You could take him to small claims court (costs you money), but then you'd have to file in the city where he lives, and show up for court in the city where he lives. Of course, he won't show up for court, in which case you then have to file a default judgment against him (costs you more money). You will then be awarded the judgment, but all that says is that this jackass kid owes you money. It's then up to you to recoup the money, the court doesn't care whether you get it or not, they got your filing fees. If the kid works, you can garnish his wages, but you must know where he works, and know his social security number. Garnishing wages costs about $100 here in my town. You could also attach his personal property. The catch here is, he has to give the county permission to have his property attached. The creditor (you), have to pay to have his property tagged, pay again to have it appraised, then pay again to have an auction held to auction the junk off to get you your money.

I've taken the time to read all of the posts about this kid. I've clicked on all the links to the other websites about this jackass, and it makes me sick. I'm not sure what I would do if this kid ripped me off. You could spend good money to chase bad money (money you'll never recover).

I think if I were in your guys' shoes, I would just take comfort in the fact that this punk kid is going to rip someone off real soon that is going to end up pounding his teeth through the back of his head.

It's simply too much time, money, and trouble to take someone to court that lives in another state. The only way this kid is going to get what's coming to him is if one of the people that got taken for cash stays on the case, and doesn't mind parting with a fair amount of cash.
