well... the bike was in KY and there were not any better options here to buy. Yes, I know it's my fault, but the dude ****ed me over... he is losing his job and needed money and tried to get the most out of a bike that was not worth it.... that is messed up. I know thatI should have gone and looked at it but that was not possible. I had several phone conversations with the guy, and he was very helpful about getting things done... he should have been an adult about it and told me everything that was wrong. This is the first bike that I have bought, didn't know exactly what to look for, just the basics.

Well from your sig. I take it you bought a cannondale. They have had a lot of problems with them. I would go into the cannondale section and talk to those guys. It probably never got any of the updates. Good luck man that really sucks that people do that.
